A workshop co-organized by the Polish Competition Law Association and Linklaters on “International trends in merger control remedies” was held on 28 June, 2017. 

Mr. Jonas Koponen, Head of Linklaters’ Global Antitrust Department, Ms. Alexandra Boutin of Compass Lexecon, and Dr Mateusz Błachucki of INP PAN were our speakers at this workshop.

The completion of the work of the ICN Merger Control Working Group on remedies (in the form of the Merger Remedies Guide 2016, http://www.internationalcompetitionnetwork.org/uploads/library/doc1082.pdf) served as the inspiration for the workshop.

Overarching principles for remedial action, types of merger remedies, and their proper design - including in the context of the risks taken into account by the authorities choosing the remedies, as well as their implementation and monitoring were presented and discussed during the workshop.

Our panelists referred to, among others, the latest EC decisions in the Baxter/ Gambro (M.6851), Liberty Global/ Zigo (M.7000), Huntsman/ Rockwood (M.7061), and Zimmer/ Biomet (M.7265) cases.

The economic part of the workshop discussed, i.a., structural and behavioral remedies, the issue of closeness of competition and of the effectiveness of remedies, as well as the relationship between remedies and efficiencies arising from mergers.
