The workshop “Assessment of undertakings’ market power in antitrust proceedings” organized by the Polish Competition Law Association, was held on Thursday, 7 May 2015.

During the workshop participants discussed about the shortcomings of commonly used methods applied to determine the relevant market and to assess market strength of undertakings, especially in the context of the incomplete reflection of the economic concepts they are based on. The up-to-date methods for assessing market power endorsed by economists along with possible difficulties related to their application in anti-trust proceedings were also covered during the meeting. The lecture ended with a debate regarding the perspective for applying discussed methods in the Polish legal system.

The workshop was led by Mr. Tomasz Kwaśniewski – a graduate of Warsaw University who also studied at Vienna University. Mr. Kwaśniewski is the author of an MA dissertation under the title: “Assessment of Enterprises’ Market Strength in Anti-Trust Proceedings” and the winner of the second prize and of the award of the Polish Competition Law Association in the competition of the UOKiK Chairperson for the best MA thesis focusing on the subject of competition protection.
