Workshop titled: Concentrations in the media sector – the latest case law of the Court of Competition and Consumer Protection

Greenberg Traurig Law Firm, in cooperation with the Polish Competition Law Association, is pleased to invite members of the Association to a workshop: Concentrations in the media sector – the latest case law of SOKiK.

In 2022, the Court of Competition and Consumer Protection (“SOKiK”) handed down important judgments in cases involving appeals against two decisions of the UOKiK Chairperson: the first prohibition decision in ten years in the Agora/Eurozet case and the unconditional approval in the Orlen/Polska Press case. These cases provide an excellent opportunity to discuss the current problems of merger control assessment in the media sector, as well as more broadly the role of the UOKiK Chairperson and SOKiK in the merger control system.

Among the many debatable issues, it is worth mentioning such as the inclusion of pluralism and media freedom issues in the merger assessment, the standard of proof and the role of analysis of economic circumstances in the case of coordinated effects, or the power of SOKiK to issue a reform judgment, especially in the context of the effectiveness of the undertaking’s legal protection.

The workshop will be held on November 24, 2022 (Thursday), at 5 p.m. (registration from 4:30 p.m.), at the new offices of Greenberg Traurig, Varso Tower, 33rd floor, 69 Chmielna St., Warsaw.

The workshop will be led by Robert Gago and Filip Drgas of the law firm Greenberg Traurig, who will give an introductory lecture and moderate the discussion. Alexandra Boutin (Founding Partner, Positive Competition) and Dr. Malgorzata Kozak (Assistant Professor, Utrecht University) will also deliver their lectures as part of the workshop.
