On March 28, 2023, we held a workshop on New rules for assessing vertical restraints in light of VBER 2022 and VGL 2022

On March 28, 2023, we held a workshop on New rules for assessing vertical restraints in light of VBER 2022 and VGL 2022 – organized together with the Domański Zakrzewski Palinka Law Firm.  The workshop was led by Dr. Jarosław Łukawski, Partner at DZP and Jan Siesicki, Associate at DZP.

It is worth mentioning that last year Jan Siesicki received the Competition Law Association’s award in the UOKiK Chairperson’s competition for the best master’s thesis, for his thesis on vertical agreements.  The opportunity to lead a workshop was the second part of the award.

During the workshop, speakers discussed key changes in the approach to vertical restraints under Regulation 2022/720 and the accompanying Guidelines.  The speakers focused in particular on the question of incorporating in VBER 2022 the experience of the Commission (and national authorities) gained on the grounds of VEBR 2010.  Speakers also considered whether the new regulations represent a step forward (or backward) in terms of the legal certainty that VBER should provide to businesses and answered the question of whether the new regulations are, in their view, a revolution or an evolution in the application of competition law to vertical restraints, and whether the changes are comprehensive or whether one can nonetheless feel a certain insufficiency.  Workshop participants were particularly interested in the changes regarding selective distribution systems and so-called fulfillment contracts.
